SMT. JUSTICE T. RAJANI CRIMINAL PETITION No.12905 OF 2011 ORDER:

The present Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 is filed by the petitioners - accused Nos.2 to 7 seeking to quash the proceedings in Calendar Case No.36 of 2010 on the file of the I Additional Judicial Magistrate of First Class, Mancherial, registered for the offences punishable under Section 498-A of the Indian Penal Code, 1860 and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

2. Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for respondent No.1 and also the learned counsel for respondent No.2.

3. The learned counsel for the petitioners submits that by virtue of the order, dated 16.09.2015, passed by a learned Single Judge of this Court in Criminal Petition M.P. (S.R.) Nos.33213 and 9742 of 2015 in/and Criminal Petition No.5495 of 2015, this Court quashed the proceedings in the aforesaid Calendar Case against accused No.1 based on the compromise entered into between the parties. The petitioners herein are father-in-law of respondent No.2 and relatives of husband of respondent No.2. Hence, when the matter is compromised between the prime accused and respondent No.2, it would be just to quash the proceedings against the petitioners herein.

In view of the above, the present Criminal Petition is allowed, and all further proceedings against the petitioners - accused Nos.2 to 7 in Calendar Case No.36 of 2010 on the file of the I Additional Judicial Magistrate of First Class, Mancherial, are hereby quashed. Consequently, Miscellaneous Petitions, if any, pending in the present Criminal Petition stand closed.
