This appeal is filed under Order XLIII Rule 1 of C.P.C. challenging the ex-parte order dated 31.03.2017 in I.A.No.138 of 2017 in O.S.No.43 of 2017 on the file of the V Additional District Judge at Bhongir.

Learned counsel for the appellants seeks permission of this Court to permit the appellants to withdraw the appeal with liberty to urge the points raised in this appeal before the trial Court by filing counter.

Permission is accorded.

Accordingly, the Civil Miscellaneous Appeal is dismissed as withdrawn granting liberty as prayed for. There shall be no order as to costs.
