HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13682 of 2017 ORDER:

As contended by the learned Assistant Government Pleader for Revenue, petitioner has alternate remedy of appeal against the impugned order dated 13.03.2017, which is not disputed by the learned counsel for the petitioner. Learned counsel for the petitioner submits that the relevant material placed by the petitioner is not being considered by the Tahasidlar, properly.

It is to be seen that when the petitioner has effective alternate remedy by way of appeal under Section 5(5) of the A.P.Rights in Land & Pattadar Pass Books Act, 1971, I do not see any reason to entertain the writ petition. Accordingly, the writ petition is disposed of granting liberty to the petitioner to file appeal by raising all the issues, and on such appeal being filed by the petitioner, the 3rd respondent is directed to consider all the objections raised by the petitioner and dispose of the appeal, in accordance with law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 18.04.2017 t k.
