HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.12610 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer of shop No.2, Yelamanchili Village, Jalumuru Mandal, Srikakulam District, on regular basis. His authorization is subsisting as on date. While so, on the basis of the inspection conducted by the fifth respondent, the fourth respondent filed a case under Section 6-A of the Essential Commodities Act. Thereafter, the third respondent issued a show cause notice, to which the petitioner submitted his explanation on 24.03.2015. After considering his explanation, the third respondent suspended the authorization pending enquiry. Challenging the same, the present Writ Petition is filed.

It is submitted by the learned counsel for the petitioner that the variation is small and, on flimsy grounds, the order was passed by the third respondent.

However, in view of pendency of enquiry, this Court is not inclined to interfere with the enquiry at this stage. The third respondent is directed to complete the enquiry, as expeditiously as possible, and pass final orders, after affording reasonable opportunity to the petitioner, within a period of two months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of at the stage of admission.

Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
