The Court made the following:

HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner is working as Conductor in respondent corporation. He claimed to have joined service in the year 1997 and services were regularized w.e.f. 01.08.1998. According to the petitioner, as per the circular of the respondent corporation dated 04.06.2005, on completion of 12 years of service in a particular category, employee is entitled for special grade pay. In terms of the said circular, petitioner is entitled to draw special pay after completion of 12 years i.e., in the year 2010. In spite of the eligibility of petitioner, special pay is not granted to him. Aggrieved by the inaction, petitioner submitted the representation dated 25.08.2014 to the Regional Manager, but the same is also not disposed of. Hence, this writ petition.

2. Learned standing counsel, on instructions, submits that the competent authority has not received the representation stated to have submitted by the petitioner on 25.08.2014 and no representation is pending with the competent authority.

3. Having regard to the said objection, when the same is ascertained from the learned counsel for petitioner, counsel for petitioner is unable to show the proof of such representation. Having regard to the same, writ petition is disposed of granting liberty to the petitioner to submit a copy of representation dated 25.08.2014 to the Regional Manager, Karimnagar or is at liberty to submit a fresh representation claiming his entitlement for sanction of 12 years special grade increment on completion of 12 years of service and as when such representation is received, the 2nd respondent shall consider the same and pass appropriate orders as warranted by law within a period

of four weeks from the date of receipt of copy of such representation. Miscellaneous petitions if any pending in the writ petition shall stand closed. There shall be no order as to costs. ___________________________ JUSTICE P.NAVEEN RAO Date: 09.02.2016 kkm
