HONOURABLE SRI JUSTICE S.RAVI KUMAR CIVIL REVISION PETITION No.1435 OF 2012 ORDER:

This revision is preferred challenging orders of Principal Junior Civil Judge dated 5-3-2012 in E.P.No.148 of 2010 in O.S.No.135 of 2002.

The revision petitioner herein is J.Dr. before the lower court. Respondent herein filed E.P.No.148 of 2010 for recovery of money granted in decree dated 23-4-2007 by ordering arrest of J.Dr. and to detain him in civil prison for realization of decretal amount. Trial court on a consideration of oral and documentary evidence of both parties allowed E.P. and ordered for arrest and detention of J.Dr. for a period of three months, aggrieved by which, present revision is preferred.

When this revision has come up for hearing on 1-2-2016, on the request of petitioner's counsel, it was adjourned to 3-2-2016 and again on 3-2-2016, advocate for revision petitioner sought for time and on his request, the matter is posted to this day. In spite of granting two adjournments, no interest is evinced in prosecuting the case. Today, neither advocate for revision petitioner present nor there is any representation.

As petitioner has not evinced any interest in prosecuting the case, this Civil Revision Petition is dismissed for nonprosecution. No costs.
