HON'BLE SRI JUSTICE SURESH KUMAR KAIT Writ Petition Nos.10174 & 10205 of 2015 COMMON ORDER:

Vide present writ petitions, the petitioners seek a direction, thereby directing respondent to renew the petitioners' passports by rectifying their date of birth.

2. Learned standing counsel for the respondent, on advance notice, submits that vide communication dated 24.04.2015, the petitioners in both the writ petitions, were directed to furnish revised birth certificate issued under RBD Act with the actual date of birth, since birth certificate is only acceptable document for those who are born on or after 26.01.1989. It is further stated therein that if the petitioners lives in the vicinity of Passport Office, Hyderabad or have been specifically asked to appear in person, they could choose to submit the required documents to the Enquiry Officer at the Passport Office on any working day from Monday to Friday between 10.00 a.m. and 12.00 Noon.

3. In view of the facts recorded above, I find no merit in these writ petitions. I hereby made it clear that the petitioners have to comply with the letter dated 24.04.2015 of the respondent and thereafter, the respondent is directed to decide the applications of the petitioners.

4. Both the writ petitions are, accordingly, dismissed. No order as to costs. Pending miscellaneous petitions, if any, in these writ petitions, shall stand closed.
