This petition is filed under Section 438 of the Code of Criminal Procedure (for short, 'Cr.P.C.') by the petitioner-accused No. 3 for grant of pre-arrest bail in Crime No. 14 of 2018 of Visakhapatnam II Town Police Station, Visakhapatnam City, registered for the offence punishable under Section 420 read with Section 34 of IPC.

After arguing the case for awhile, learned counsel for the petitioner has requested this Court to direct the concerned police to follow the procedure under Section 41-A of Cr.P.C. and the guidelines issued by the Apex Court in Ar n esh Ku m ar Vs. St at e of Bih ar an d an ot h er 1.

Acceding to the request of learned counsel for the petitioners, the Station House Officer, Visakhapatnam II Town Police Station, Visakhapatnam City, is directed to follow the procedure under Section 41-A of Cr.P.C. and the guidelines issued by the Apex Court in Ar n esh Ku m ar (supra). 1 2014 (2) ALT (Crl.) 457 (SC)

With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions, if any, in this criminal petition shall stand closed in consequence.
