THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.369 of 2017 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 6th respondent in not disposing the appeal filed by the petitioner against orders, dated 07.10.2016, passed by the 1st respondent, as illegal and arbitrary and consequently, direct the revenue authorities not evict petitioner from the subject land. Heard and perused the material available on record. The main grievance of the petitioner is that the 1st respondent passed an ejectment order, dated 07.10.2016, against the petitioner and others in respect of the land in possession of the petitioner and others, in LTR Case No.
1/ 2016/ Bvm, and against the said order, the petitioner preferred an appeal before the 6th respondent along with an application for stay of the said order, but the 6th respondent is not passing any orders on the stay petition and meanwhile, the 1st respondent is taking steps to dispossess the petitioner from the subject land. Considering the circumstances of the case, without expressing any opinion on merits, this Court is inclined to pass the following order: The 6th respondent is directed to consider the appeal preferred by the petitioner and pass appropriate orders in accordance with law as expeditiously as possible. Till disposal of the appeal, the authorities concerned are directed not to interfere with the possession of the petitioner in respect of the subject land.
Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J January 04, 2017.
