THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.NOs.8717, 8824 AND 8837 OF 2019 COMMON ORDER Aggrieved by the circular dated 17.10.2011 issued by the respondent - company, in restricting the age of the employees to refer to Medical Board, for declaring them as medically unfit, the present writ petitions have been filed. With the consent of both the counsel, the matters are being disposed of at the stage of admission.
Learned counsel for the petitioners and the learned Standing Counsel for the respondent - company submits that the company issued a fresh circular dated 21.01.2019 and in view of the latest circular, the grievance of the petitioners stood resolved, and considering similar facts and circumstances in W.P.No.561 of 2019 and batch dated 21.01.2019, this court directed the respondents to consider the case of the petitioners therein, in terms of circular dated 21.01.2019, and that similar order may be passed in the present writ petitions.
Having regard to the facts and circumstances and the above submissions of the learned counsel, without expressing any opinion on merits, the writ petitions are disposed of directing the respondents / competent authority, to consider the case of the petitioners in terms of circular dated 21.01.2019 and take appropriate action in accordance with law. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
