HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.16990 of 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties.
The petitioner - Self Help Group was appointed as a fair price shop dealer of shop No.30, Machavaram Village, Ponnuru Mandal, Guntur District by proceedings dated 12.06.2008. It appears that, at the instance of the fourth respondent, proceedings, under Section 6-A of the Essential Commodities Act, were initiated against the petitioner. The third respondent issued a show cause notice on 17.07.2013 and, on the same day itself, he suspended the authorization of the petitioner until further orders. The petitioner submitted their explanation and, in spite of the same, for the last two years, no final orders have been passed by the third respondent.
In the circumstances, the Writ Petition is disposed of directing the third respondent to complete the enquiry, pursuant to the show cause notice dated 17.07.2013, within a period of thirty days from the date of receipt of a copy of this order, as proceedings initiated by him are different from 6-A proceedings pending before the second respondent. Needless to observe that the third respondent shall follow principles of natural justice, and also binding decisions of this Court.
The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
