THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 3567 of 2016 ORDER:- Petitioner, who claims to be the owner and pattadar of the land to an extent of Ac.21-26 guntas in Survey No.1532 of Masaipally Village of Kosgi Mandal, had been issued pattadar passbooks and title deeds in respect of the said land. While the matter stood thus, the respondent authorities started digging pits in some part of the subject land under the scheme of Mission Kakatiya for development and preservation of minor irrigation tanks. Since the Government is not taking up acquisition proceedings, whereby petitioner is not able to cultivate the said land, petitioner has made a representation, dated 06.07.2015 to the respondents for initiation of land acquisition proceedings and to pay compensation. Alleging inaction on the part of the respondents in considering his application, the present writ petition is filed.

2. Learned Government Pleader for Irrigation as well as learned Government Pleader for Revenue has not received any instructions in the matter.

3. Since the representation of the petitioner is pending with respondent Nos.2 and 3. I deem it appropriate to direct respondent Nos.2 and 3 to examine the said representation of the petitioner and take appropriate decision and communicate the same to the petitioner after getting appropriate report from the fifth respondent within six weeks from the date of receipt of a copy of this order.

With the above direction, writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
