HONOURABLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 432 of 2016 ORDER:

The contempt case is filed complaining noncompliance of the order of this Court in W.P.No.4793 of 2015 dated 02.03.2015.

Counter affidavit has been filed by the respondent stating that there is an element of delay in complying with the order and final order has been passed on the application of the petitioner on 17.02.2016.

Learned counsel for the petitioner submits that the order has been passed non-considering the material on record.

In as much as the order dated 17.02.2016 is an appelabe order, and as alternative remedy of appeal or revision is available to the petitioner, and the scope of contempt being limited, I do not consider it appropriate to deal with the contentions raised by the petitioner. However, it may not be out of place to observe that the order dated 17.02.2016 is laconic and does not appear to have considered various submissions, which the petitioner had made and which are required to be considered, while passing order under the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971.

The contempt case is, accordingly, closed. No order as to costs.
