HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.533 of 2017 ORDER:
Heard the learned counsel for petitioner, and the learned Government Pleader for Home (TG) appearing for the respondents 1 & 2. Though notice served on respondent No.3de-facto complainant, he failed to attend and it is taken as heard; and perused the prayer in the writ petition with supporting affidavit and other material on record. The prayer in the writ petition is as under:
" to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Certiorari calling for the records in Crime No.545 of 2016 on the file of the Karimnagar I Town Police Station, Karimnagar, Karimnagar District and quash the same and pass such other order or orders as are deemed fit and proper in the circumstances of the case."

The supporting affidavit averments in the writ petition are that the petitioner-A2 is a private employee and he is innocent and the case is foisted by roping him along with A1 with omnibus allegations are constrained to knock the doors of the Court.

On 05.01.2017, this Court granted blanket order of stay of all further proceedings in Crime No.545 of 2016 on the file of the Karimnagar I Town Police Station, Karimnagar, as far as the petitioner-A2 is concerned for a period of eight weeks. Later, there was no extension of the said interim order.

In fact, a perusal of the very report of the de-facto complainant-father of victim girl makes out the allegations mainly against A1 and so far as the petitioner-A2 is concerned, he is also telephoning to minor daughter of the de-facto complainant to accommodate A1 by teasing him with sexual harassment.

Having regard to the above, there is nothing to stall the investigation or to stay further proceedings in Crime No.545 of 2016 even as far as the petitioner-A2 is concerned. 6.
Accordingly, this Writ Petition is dismissed and respondent No.2 is directed to complete the investigation and file the final report within two (2) months from today. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
