SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2843 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A2, A4, A6 and A8, in Crime No.62 of 2017 on the file of Puttaparthy Rural Police Station, Ananthapuramu District. The offences alleged are under Sections 341, 354, 324, 506 r/w 34 IPC and Section 3(1)(r)(s) of SC/ST POA Amendment Act, 2015.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The case of the prosecution is that these petitioners, along with other accused, abused the defacto complainant in her caste name. Hence, in the above circumstances and when the petitioners counsel is not able to make out any ground on the basis of which he can say that the SC/ST POA Act is not attracted, Section 18 of the Act comes in the way of granting anticipatory bail to the petitioners. 4.

Accordingly, the Criminal Petition is dismissed.

However, in the event of any necessity of arrest of the petitioners, the police shall strictly follow Section 41A of Cr.P.C. and the guidelines laid down by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1.
