Respondents Counsel for the Petitioners :
---------- Counsel for the Respondents:
Mr.Soma Konda Reddy for R5,6,8,9,10,11,12,13&14 Mrs. M.Bhaskara Laxmi Standing counsel for APHC The Court made the following:
Order: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed assailing letter in Dis.No.79/DLSA/2008, dated 15.12.2008, addressed by respondent No.3 to respondent No.4.
2.
At the hearing, there is no representation for the petitioners. We have perused the impugned proceedings, which are only in the nature of a letter addressed by respondent No.3 to respondent No.4. In the said letter, respondent No.3 has referred to certain facts and inter alia stated as under:
"The Chairman further stated that Rs.58,28,309/- is lying in the name of Chairman cum District Judge, District Legal Services Authority, Kurnool. Neither the petitioners nor Special Deputy Collector, Srisailam Project, Kurnool, have furnished particulars with regard to quantum of compensation to be paid to the said petitioners. The District Legal Services Authority, Kurnool has no objection to make necessary payments to the said petitioners subject to their eligibility, provided that the Special Deputy Collector, Srisailam Project, Kurnool, furnishes particulars with regard to quantum of compensation to be paid to the said petitioners. This authority is not aware of actual claim of the petitioners. Therefore Sri Somakonda Reddy, Advocate is advised to instruct their clients i.e. petitioners in W.P.No.5280 of 2006 to furnish the details of Lok Adalat Awards, actual quantum of compensation, if any, settled before Lok Adalat as agreed in the manner as stated by the clients to this authority within a week after receipt of this reply notice.
This authority has received the Pro-orders in respect of the claims of the petitioners in E.P.No.62 of 2008 to 91/2008 and 93/2008 to 98/2008 and so the Pro-orders
cannot be implemented and forwarding the above information for consideration of the above pro-orders". 3.
We do not understand as to how the views expressed by respondent No.3 in his letter addressed to respondent No.4, are detrimental to the interests of the petitioners. On the contrary, respondent No.3 has fairly and frankly stated that the District Legal Services Authority, Kurnool, has no objection to make necessary payments subject to their eligibility, provided the Special Deputy Collector, Srisailam Project, Kurnool, furnishes the particulars with regard to the compensation to be paid to the petitioners. Interpreting the impugned communication in any manner, we are of the opinion that the same does not affect the interests of the petitioners. 4.
In the light of the above, we do not find any merit in this writ petition and the same is, accordingly, dismissed. __________________________________ (C.V.Nagarjuna Reddy, J) _____________________ (Gudiseva Shyam Prasad,J) Date: 16th August, 2018 msb
