Chopperla Balaraju v. Kota Suryarao
THE HONOURABLE SRI JUSTICE RAJA ELANGO CIVIL REVISION PETITION No.2169 OF 2016 ORDER:
The Civil Revision Petition is filed under Article 227 of the Constitution of India being aggrieved by the order, dated 18.02.2015, passed in I.A.No.3 of 2014 in O.S.No.5 of 2014, by the Court of the Sub Divisional Magistrate, Mobile Court, Rampachodavaram, whereby the learned Sub Divisional Magistrate vacated the temporary injunction orders dated 13.10.2014 passed in I.A.No.3 of 2014.
Heard and perused the material available on record. Learned counsel for the petitioner submits that the Court below erroneously vacated the injunction orders on the basis of the conjectures and surmises and as such, he seeks to set aside the vacate orders. On hearing both sides, this Court is not inclined to interfere with the impugned order passed by the Court below. However, the Court below is directed to dispose of the suit as expeditiously as possible, preferably within a period of six months.
The civil revision petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
