N.Venkatesh v. Sri Raja Gopal
THE HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR CONTEMPT CASE No.817 OF 2017 ORDER:
The present Contempt Case, under Sections 10 to 12 of the Contempt of Courts Act, came to be filed questioning the action of the respondent authority in not complying the order dated 25.10.2016 passed by this Court in Writ Petition No.35933 of 2016, wherein this Court directed the respondent to dispose of the application made by the petitioner on 26.05.2016 in Form 6A pursuant to the order of this Court in Writ Petition No.12854 of 2016, dated 19.04.2016 after hearing the petitioner and the aggrieved persons, if any, in accordance with law, as early as possible preferably within a period of six (06) weeks from the date of receipt of a copy of the order.
2.
A counter came to be filed stating that pursuant to the orders passed by this Court, respondent herein passed an order dated 23.05.2017 rejecting the request of the petitioner. Though there is a delay in passing the order, but the order itself indicates that subsequent to the order of this Court, number of writ petitions came to be filed by the petitioner viz., W.P.No.27113 of 2013, 12854 of 2016 and 32074 of 2016 etc.
3.
However, learned Assistant Government Pleader would contend that in view of filing of several writ petitions by the
petitioner, there was a delay in complying with the orders passed by this Court.
4.
Accepting the explanation given for the delay and in view of grievance of the petitioner now addressed to, the Contempt Case is closed. However, the petitioner is always at liberty to question the orders passed by the authorities on his application. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. No order as to costs. _______________________ JUSTI CE C. PRAVEEN KUMAR Date:04.08.2017 INL
