Heard.

2. Petitioner's authorization of fair price shop No.36 at Mohabathnagar,

Maheshwaram Mandal was valid up to 31.02.2012. Petitioner had not taken any steps for renewal of his authorization in accordance with the Rules but had paid challan for renewal together with late fee only on 17.09.2014 and also submitted a fresh challan for security deposit. Petitioner states that while no orders are passed on his renewal application, his authorization has been cancelled by respondent No.3 by order dated 25.11.2014 and aggrieved thereby, he has filed an appeal before the second respondent on 23.12.2014 along with an interim application for stay.

3. Though the present writ petition is filed questioning the order of the third respondent dated 25.11.2014, in view of the fact that the petitioner has filed an appeal against the said order and the same is pending with the second respondent, it would not be appropriate to entertain this writ petition. However, since the petitioner's appeal is required to be heard and disposed of, on merits, the second respondent is directed to consider the petitioner's appeal, on merits, in accordance with law and pass appropriate orders thereon expeditiously, preferably, within a period of four (4)weeks from the date of receipt of a copy of this order.

The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V. AFZULPURKAR, J January 23, 2015 DSK
