THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA APPEAL SUIT No.2172 of 2002 JUDGMENT:

This is a suit for partition. The defendants aggrieved over the judgment & decree granting relief of partition, the present appeal is preferred. On 29-08-2017, when this first appeal was called, there was no representation for the appellants, whereas the learned counsel for the respondents was present. Therefore, the Registry was directed to list the matter under the caption 'for dismissal'. Today also there is no representation for the appellants. Learned counsel for the respondents 1 to 6 & 7 representing each set of respondents are present.

It appears that the appellants are not interested in prosecuting the appeal suit. Therefore, the present appeal is dismissed for nonprosecution. 3.

Hence, the present appeal suit is dismissed as withdrawn. No costs.

As a sequel, miscellaneous petitions, if any, pending in this Appeal Suit, shall stand dismissed.
