THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36131 OF 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action on the part of the respondents 2 to 4 in not registering the crime against the accused based on the complaint, dated 07.10.2016 as illegal and arbitrary, and consequently, to direct the respondents 2 to 4 to register the crime and investigate into the complaint dated 07.10.2016 given by the petitioner. Heard and perused the material.

Learned counsel for the petitioner submits that though the petitioner lodged complaint, dated 07.10.2016, the respondents 2 to 4 are not registering the complaint and as such, he prays this Court to direct the respondents 2 to 4 to register the complaint and take action against the accused.

Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to the respondents 2 to 4 to register the complaint of the petitioner, if it discloses any cognizable offence, and conduct effective investigation and file final report, if any, in accordance with law.
