HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.21394 of 2011 ORDER:

The relief sought for in this Writ Petition is to declare the action of the respondent in interfering with the functioning of the tower, by locking and sealing the tower without giving any prior notice and without giving an opportunity of hearing to the petitioners, as arbitrary and illegal.

By way of interim relief, the petitioners sought a direction to the Grampanchayt not to interfere with the functioning of the tower erected by them, by opening the lock, pending disposal of the Writ Petition. This Court, by order in WPMP No.26042 of 2011, granted interim direction as prayed for. The said interim order is in force for the past more than seven and half years, and the petitioner is said to be operating the tower ever since.

Suffice it, therefore, to dispose of the Writ Petition directing the respondent grampanchayat to put the petitioner on notice, and give them an opportunity of being heard before taking any coercive action to lock and seal the tower.
