A.S.M.P.No.1706 of 2015 is filed to record the compromise entered into between appellant No.8 (defendant No.2 in O.S.No.5 of 2001) and the 1st respondent (plaintiff in O.S.No.5 of 2001).

Both appellant No.8 and the 1st respondent-plaintiff are present in Court today, and have been identified by their counsel Sri Mohd. Saleem and Sri A.V.Sivaiah respectively. Both appellant No.8 and the 1st respondent-plaintiff state that they have understood the terms of the memorandum of compromise, and have voluntarily signed it. The 1st respondent also states that she has received a sum of Rs.17,50,000/- in terms of the compromise.

As the 1st appellant died after the decree was passed in O.S.No.5 of 2001, the appeal was contested by appellants 2 to 8. This Court, by its order in A.S.M.P.Nos.1773 and 1774 of 2009 in A.S.No.471 of 2005 dated 09.12.2009, recorded the compromise between appellants 2 to 7 and the 1st respondent-plaintiff.

As appellants 2 to 7 have already entered into a compromise with the 1st respondent-plaintiff, and as the 8th appellant has now entered into a compromise with the 1st respondent-plaintiff, A.S.M.P.No.1706 of 2015 is ordered; and the appeal in A.S.No.471 of 2005 is disposed of in terms of the compromise.
