THE HON'BLE Dr . JUSTI CE SHAMEEM AKTHER W RI T PETI TI ON No.9 0 3 0 OF 2 0 1 9 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to direct the respondent authorities to enquire into the complaint, dated 26.03.2019, of the petitioner and to dispose of ARC No.622 of 2016 pending before respondent No.2, as per law, and take appropriate action against respondent Nos.6 to 9.

2 .

Heard learned counsel for the petitioner and the learned Government Pleader for Co-operation, appearing for respondent Nos.1 and 2, and perused the record.

3 .

Learned counsel for the petitioner would contend that a complaint, dated 26.03.2019, is lodged by the petitioner to enquire into the dual membership of respondent Nos.6 to 8 and to take action accordingly. He would also contend that respondent No.3 filed a case in ARC.No.622 of 2016 before respondent No.2 against respondent Nos.4 and 6 to 9 and the same is pending. No action is taken yet on the complaint, dated 26.03.2019, of the petitioner and the case in ARC.No.622 of 2016. Hence, the present Writ Petition is filed. 4 .

In view of the submissions made by both sides, there is no dispute with regard to filing of complaint, dated 26.03.2019, by the petitioner and pendency of a case in ARC.No.622 of 2016 before respondent No.2. No action is taken yet on the

complaint, dated 26.03.2019, of the petitioner. The contentions raised on behalf of the petitioner are required to be addressed expeditiously, before the disposal of said ARC. Under these circumstances, respondent No.2 authority is directed to enquire into the complaint, dated 26.03.2019, of the petitioner and dispose of the same, as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order.

5 .

With the above direction, the Writ Petition is disposed of at the stage of admission.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. ______________________ Dr . SHAMEEM AKTHER, J April 25, 2019.
