THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.2769 of 2018 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the petitioners seeking to quash the proceedings against them in D.V.C.No.1 of 2017 pending on the file of I Additional Judicial Magistrate of First Class, Khammam.

Heard the learned counsel for the petitioners, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

In Domestic Violence Cases, day-to-day appearance of respondents therein is not required in the Court below and the Court below shall not insist the appearance of the respondents in Domestic Violence Cases unless there is a specific purpose to do so.

The petitioners are granted liberty to agitate their grievances under Section 29 of the Protection of Women from Domestic Violence Act. As there is an efficacious remedy available to the petitioners, this petition is not maintainable. 5.

With the above observation, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
