HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.30390 OF 2016 ORDER:
According to the petitioner, he filed suit in O.S.No.131 of 2016 on the file of Principal Junior Civil Judge, Gajwel against the 2nd respondent claiming rights in respect of subject land and also filed petition for injunction. As no orders are passed in the injunction petition, the present writ petition is filed.
Learned Standing Counsel for 2nd respondent states that having filed civil suit before the Court below, the petitioner cannot pursue two parallel remedies. Having regard to the above, the petitioner cannot pursue two parallel remedies, one by way of civil suit and another by way of writ petition. In view of the same, I am not inclined to entertain the writ petition.
Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
