Palle Somaiah v. The State Of Telangana
IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH **** WRIT PETITION NO.39211 OF 2015 DATED 10th DECEMBER, 2015 Between:
Palle Somaiah .. Petitioner and The State of Telangana rep. by its Principal Secretary, Mines & Geology Department and others .. Respondents
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.39211 OF 2015
O R D E R
The grievance of the petitioner was that necessary orders were not being passed for grant of a quarry lease for black granite over the land which was the subject matter of his application despite the same being recommended by the Irrigation authorities. The Assistant Director of Mines and Geology, Nalgonda, furnished written instructions to the office of the learned Government Pleader for Mines and Geology, wherein he stated that necessary proposals for finalization of the grant of the quarry lease to the petitioner were under process and would be sent to the Director of Mines and Geology, State of Telangana, Hyderabad, as per rules in due course, so that appropriate orders are passed on the petitioner's application.
In that view of the matter, as the petitioner's application is stated to be still under process, this Court sees no purpose served in keeping this petition pending for a counter and for further adjudication. The writ petition is accordingly disposed of directing the mining authorities concerned to consider the petitioner's quarry lease application in accordance with law and take appropriate action in the matter in accordance with law within three months from the date of receipt of a copy of this order. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
