ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in Crime No.324 of 2026 before the L.B. Nagar Police Station, Malkajgiri Commissionerate, registered for the offence

punishable under Section 144(2) of BNS, Section 3(1), 3(2)(a) and 4 of Prevention of Immoral Trafficking Act, 1956 and Section 5(1)(a) and 7 of Prevention of Immoral Trafficking (Amendment) Act, 2006.

The brief facts of the case are that on 10.03.2026, based on credible information, the police conducted a raid at Vashista Residency Luxury Rooms, LB Nagar, where illegal prostitution activities were allegedly being carried on. During the raid, the police found the receptionist organizing prostitution by arranging sex workers and customers and collecting money. Two customers were found with victims in separate rooms, and certain material objects including mobile phones, condoms, a register, and DVR were seized. The accused persons were apprehended, and a case was registered for the above said offences.

Heard Sri Ch. Raj Kumar, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachander Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner was falsely implicated and no specific overt acts were attributed to him in the complaint and that the allegations were vague and omnibus in nature. He further submitted that the investigation was substantially completed, material witnesses were already examined, and had been in judicial custody since 10.03.2026. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the petition contending that the accused persons were involved in organized prostitution activities and were caught red-handed during the raid and that the petitioner was part of the illegal activity and was involved in facilitating immoral trafficking. He contended that the offences were serious in nature affecting public morality and order, and releasing the petitioner on bail may hamper the investigation or enable continuation of such illegal activities. Further, the investigation was not yet completed. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 10.03.2026. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 10 witnesses have been examined.

Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the II AJCJcum-II AJMFC, Ranga Reddy District at L.B. Nagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of

investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
