THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY CIVIL REVISION PETITION Nos.332 AND 344 OF 2016 COMMON ORDER:
These revision petitions are filed against the orders, dated 16.12.2015, passed in I.A.Nos.302 and 303 of 2015 in O.S.No.5 of 2006 on the file of V Additional District Judge, Nandyal, Kurnool District, wherein the applications filed by respondent No.1 - plaintiff for reopening and recalling the evidence of PW.1 were allowed.
Though notice is served on the respondents, none appears for them.
From a perusal of the impugned orders, it is clear that no reasoning was given by the Court below while allowing the aforesaid applications, that too when the Suit is posted for arguments after closure of the evidence on either side. Hence, without going into merits of the matter, only on the ground that the impugned orders do not contain reasons, they are liable to be set aside. Accordingly, the revision petitions are allowed setting aside the impugned orders, dated 16.12.2015. Since the reasons stated in the affidavits filed in support of the aforesaid applications are vague, the aforesaid applications stand dismissed.
Miscellaneous Petitions, if any, pending in these revision petitions, shall stand closed. No costs. __________________________
