HIGH COURT FOR THE STATE OF TELANGANA THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITION NO.219 OF 2013 ORDER:
On earlier occasion, i.e on 05.12.2019, this Court has recorded the assertion made by the learned counsel for the respondent that, as a matter of fact, the claims of the petitioner, viz, State Bank of Hyderabad, consequent upon its merger with State Bank of India, were settled under the Resolution Plan before the NCLT, Hyderabad Bench, vide proceedings in I.A.No.66 of 2019 in CP(IB).No.41/7/HDB/2017, dated 03.06.2019. However, since there was no representation for the petitioner, the matter was directed to be listed today, i.e 06.12.2019, under the caption "for dismissal".
It may be noted that State Bank of Hyderabad has merged with State Bank of India, and in terms of said Resolution Plan, as approved by the NCLT under the Insolvency and Bankruptcy Code, 2016, the claims of State Bank of India, being one of the financial creditors, stood settled.
In those circumstances, there being no denial of this aspect by the learned counsel for the petitioner, this Court is satisfied that the matter stands settled, and no further orders are required to be passed in this Company Petition.
Accordingly, the Company Petition is closed.
