THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.8856 OF 2019 ORDER:
The prayer of the petitioners in this case reads as under. "...to issue Writ, Order or direction more particularly one in the nature of Writ of Mandamus by declaring inaction of Respondent Nos.1 to 4 in not passing any orders on petitioners' representations dated 22.05.2017, 15.07.2017, 28.10.2017, 12.03.2018, 24.03.2018 and 18.08.2018 as illegal, false and against the principles of natural justice and consequently direct the respondent Nos.1 to 4 to conduct departmental enquiry on the misplacement of original SES beneficiaries List in 3 sets at office of respondent No.3/R.D.O. and 1 set in office of respondent No.4/Tahsildar to allot houses at Veerannagutta, Amberpet, Hyderabad." Learned Assistant Government Pleader would inform this Court that on the strength of the representations made by the petitioners, the Tahsildar, Amberpet already conducted an enquiry and submitted a report to the Revenue Divisional Officer, Hyderabad. He would state that appropriate orders would be passed on the basis of the aforestated enquiry and the decision would be communicated to the petitioners.
The petitioners' representations were made in the years 2017 and 2018 and there is no reason forthcoming as to why the same should be kept pending indefinitely. Further, as this Court is not going into the merits of the case, there is no necessity to put Respondents 5 and 6 on notice or afford them an opportunity of hearing at this stage.
The Writ Petition is accordingly disposed of directing the revenue authorities to take appropriate action on the strength of the petitioners' representations and the enquiry report which
emanated as a result thereof and communicate the decision to the petitioners. This exercise shall be completed expeditiously and in any event, not later than four (4) weeks from the date of receipt of a copy of this order.
