THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.16804 of 2015 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) The inaction of the respondent, in not disposing of the petitioner's application for registration as a dealer under the AP VAT Act, is questioned in this writ petition as being arbitrary and illegal.

When the matter came up earlier, Sri Shaik Jeelani Basha, learned Special Standing Counsel for Commercial Taxes, sought time to obtain instructions. Today the learned Special Standing Counsel has placed before us a copy of the endorsement issued by the Assistant Commercial Tax Officer, Parchur Circle dated 17.07.2015, calling upon the petitioner to furnish certain information, to contend that, even after receipt of the said endorsement, the petitioner failed to furnish the information sought for by the Assistant Commercial Tax Officer and, therefore, the petitioner's application, for registration as a dealer under the AP VAT Act, has not been considered till date. Sri S.

Krishna Mohan, learned counsel for the petitioner, submits that the petitioner would furnish the information sought for by the Assistant Commercial Tax Officer, Parchur Circle within four weeks from today. On such information being furnished by the petitioner, the respondent shall consider the petitioner's application, for registration as a dealer under the Act, within six weeks thereafter, pass orders in accordance with law, and communicate the same to the petitioner. The Writ Petition stands disposed of accordingly. No costs. Consequently, miscellaneous applications pending if any, shall stand closed.
