THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.12235 of 2017 ORDER:
This Writ Petition is filed challenging the action of respondent No.4 in taking away the vehicle of the petitioner i.e., Ashok Leyland lorry bearing No.AP 29 U 5545 and challenging the inaction of respondent Nos.1 and 2 in registering a case against Nos.4 and 5.
Admittedly, the lorry was taken under an agreement of finance from respondent Nos.4 and 5 and respondent Nos.4 and 5 might have exercised their right pursuant to the said agreement. If there is any violation of the clauses of the agreement, it is open to the petitioner to take appropriate proceedings in accordance with law. Respondent Nos.1 and 2 have no role to play in that regard.
The Writ Petition is, accordingly, disposed of with the above observation. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
