THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO WRI T PETI TI ON No.7319 OF 2018 ORDER:

This Writ Petition is filed challenging the Notice dated 27.2.2018 issued by the 2nd respondent under Section 3 of Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977. 2.

It is the case of the petitioner that the agricultural land of an extent of Ac.5.00 guntas situated in Survey No.41 of Khanamet Village, Serilingampally Mandal, Rangareddy district was originally allotted to one G.Muthyalu under Rule 9(G) of Laoni Rules, 1950. He developed the said land for agricultural purpose and his name was recorded in the Revenue Records. Consequent to the urbanization of Hyderabad, the said land was converted as nonagricultural land and a family settlement took place among the family members of the said G.Muthyalu in January, 2004. The five children of the said Muthyalu got Ac.1.00 each to their share. Later on, said Muthyalu died. One of the sons of said Muthyalu leased out an extent of 2837 sq.yrds. of open land with house bearing No.241/6/5/6, Izzatnagar, Khanamet Village, Serilingampally Mandal, Rangareddy district to the petitioner by executing a Registered Lease Deed. After taking the said land on lease, the petitioner applied for running a Bar and Restaurant under the name and style, "M/s.Ruchi India Restaurant and Bar" and he was running the same

under a license issued by the Excise Department. While so, the present notice was issued.

Since this is a notice issued under Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977, this Court is not inclined to interfere with the same at this stage. It is open to the petitioner to submit appropriate reply to the said notice and it is for the 2nd respondent to pass appropriate orders in accordance with law. Till a final order is passed, the 2nd respondent shall not interfere with the possession of the land of the petitioner.

Writ Petition is disposed of.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
