District, Rep. by Public Prosecutor High Court at Hyderabad ....Respondent Petition under Section 438 of Cr.P.C, praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to grant anticipatory bail to the Petitioner/accused No. 1 to 3 by directing the SHO P.S.Korutla or any arresting officer to enlarge them on biil in the event of his arrest in connection with criem No 109/2019 of P.S.Korutla Jagitial District;

The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the argumenls of K VENUMADHAV Advocate for the Petitioners, and of PUBLIC PROSECUTOR, for the Respondent, the Court made the following. ORDER:

The petitioners are A.1 to A.3 in Crime No.109 of 2019 on the file of Korutla Police Station, Jagtial District, registered under Sections 420, 290 and 506 IPC' By way of this petition, they seek anticipatory bail under Section 438 CrPC. Perusal of the record demonstrates that the complainant alleged that her husband did real-estate business during his lifetime and after his accidental death she asked the petitioners/accused to settle the accounts and return the balance due, but they failed to do so. It is on this complaint that the present FiR was registered.

Thls Court is of the opinion that the petitioners / A.1 to A.3 in Crime No.109 of 2019 would be entitled to grant of pre-arrest bail on some conditions, as their custodial interrogation may not be necessary in a case of this nature. The Criminal Petition is accordingly allowed. In the event of arrest of the petitioners/A.1 to A.3 in Crime No.109 of 2019 on the file of Korutla Police Station, Jagtial District, they shall be enlarged on bail upon their furnishing personal bonds for a sum of Rs.10.000/- (Rupees Ten Thousand only) each along with two sureties for a like sum each, to the satisfaction of the Station House Officer, Korutla Police Station, Cyberabad. The petitioners/A.1 to A.

3 shall however abide by the conditions prescribed in Section 438 (2) CrPC, and report before the Statlon House Officer, Korutla Police Station, on every alternate Monday between 9.00 AM and 11.00 AM till the filing of the final report / charge-sheet.
