THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.M.P.No.17307 of 2014 in Crl.P.No.16032 of 2014 and Crl.P.No.16032 of 2014 Common Order:
The de facto complainant and her counsel Sri S.A.V.Sai Kumar are present. Accused Nos.1 and 3 and their counsel Sri M.A.K.Mukheed are present. A.2-Janjirala Jamuna Rani is the mother of A.1. A.2 is absent due to her ill-health and she is being represented by A.3, who is her G.P.A holder. Heard both sides and perused the petition.
The Police of Keesara P.S filed charge-sheet in Crime No.258/2012 against the accused for the offences under Sec.498-A IPC and Sec. 4 and 6 of Dowry Prohibition Act and the learned X Metropolitan Magistrate, at Malkajgiri, Cyberabad took cognizance of the same and registered as C.C.No.1193 of 2012.
While-so, now the submission of both parties is that at the intervention of elders, they have amicably resolved their disputes and in fact the defacto complainant and A.1 have obtained divorce by mutual consent in O.P.No.456 of 2014 before the Judge, Family Court, Ranga Reddy District, at L.B.Nagar, Hyderabad on 31.10.2014 and they have also resolved their disputes in the present criminal proceedings and thereby, the defacto complainant agreed for quashment of the proceedings. The parties thus prayed to permit them to enter
into compromise and quash the proceedings in C.C.No.1193 of 2012 on the file of X Metropolitan Magistrate, at Malkajgiri, Cyberabad in the interest of justice.
Having regard to the above submission and considering the fact that it is a matrimonial matter wherein the parties have amicably resolved their disputes and no useful purpose will be served even if the parties are driven to trial and also considering the decision of Apex Court reported in Gian Singh vs. State of Punjab and another[1], this petition is allowed and permission is accorded and compromise is recorded and consequently the proceedings in C.C.No.1193 of 2012 on the file of X Metropolitan Magistrate, at Malkajgiri, Cyberabad are hereby quashed.
In the result, both the petitions are accordingly disposed of.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
