THE HON'BLE SRI JUSTICE A. RAJASEKHAR REDDY C.R.P.No.588 of 2015 ORDER:

This civil revision petition is filed challenging the order dated 29.01.2015 passed in I.A.No.34 of 2015 in F.C.O.P.No.286 of 2011 by the Judge, Family Court-cum-VI Additional District Court, Nellore, dismissing the application filed by the petitioners to condone the delay in filing the documents and receive the same as evidence and mark as exhibits on behalf of the petitioners.

Heard learned counsel for the petitioners.

The main O.P. was filed by the respondent for custody of the ward who is in the custody of the petitioners. The present application was filed by the petitioners herein when the matter was posted for respondent's evidence. The documents filed along with the petition are news papers to show that the adopted mother and father are harassing the children. The trial Court dismissed the said application by observing that the documents, filed by the petitioners are not relevant to the facts of the case and it is the respondent who has to establish his case for custody of the child and that the documents filed are general news items published in a newspaper.

As rightly held by the trial Court the petition is vague and no such petition can be entertained. The trial Court is also right in holding that the respondent has to establish his case for custody of the child. Since the documents filed are general news items published in a newspaper and have no relevance to the issue in the O.P., the revision petition is misconceived. It is filed only to satisfy the personal egos of the petitioners. I see no merit in the revision petition and the same is liable to be dismissed.

Accordingly, the Civil Revision Petition is dismissed. However, the trial Court is directed to dispose of the O.P. itself within a period of six months from the date of receipt of a copy of this order. No costs. As

a sequel, miscellaneous petitions, if any, shall stand closed. ____________________________ A. RAJASEKHAR REDDY, J.
