SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2717 OF 2018 ORDER:
This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioner, who is sole accused, on bail in Crime No.64 of 2017, on the file of Woman Police Station, Adilabad, for the offences punishable under Sections 496, 493, 313, 506 r/w 34 of IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The case of the prosecution is that the defacto complainant was living with her mother and this petitioner proposed to marry her and she initially disagreed for the same, but, later agreed for a marriage, later he took the defacto complainant and married her. She had pregnancy, but the petitioner took her to a hospital for aborting the same. When the doctor at Rama-Ashok hospital refused to abort, he took her to Sanjeevini Hospital and later got her aborted. He later kept her in a rented house and escaped. The public prosecutor submits that the investigation is still in progress and that the medical record pertaining to the abortion of the defacto complainant has yet to be collected.

Hence, this Court opines that this petition cannot be allowed considering the stage of the investigation. 5.
Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 13.03.2018 SS
