These petitions are filed under Article 227 of the Constitution of India questioning the orders in I.A.No.94 of 2016, and I.A.No.95 of 2016, filed under Order XVIII Rule 17 read with Section 151 CPC, for recall and reopening the evidence of defendants in O.S.No.150 of 2006 to cross examine DW.2; but the counsel for the respondent, while submitting that the suit is being dragged on for one reason or the other, reported no objection to reopen the evidence and recall DW.2 for cross examination of DW.2.

Therefore, in view of the endorsement made by the counsel on both the petitions, the petitions are ordered with a direction to the trial Court to dispose of the suit as expeditiously as possible; in any event, not later than two months from the date of the order. No costs. Miscellaneous petitions, if any pending, shall stand closed.
