HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17854 OF 2017 ORDER:

This writ petition is filed by the petitioner challenging the action of the respondents in not considering his application dated 8.10.2015 for grant of PL/QL for Barites over an extent of Ac.54.00 cts in Sy.No.721/4, Medipentla village, Vemula Mandal, YSR District, and in not granting lease in his favour.

It is the case of the petitioner that he submitted an application in Form-B for prospecting licence in terms of Rule 9(1) of Mineral Concession Rules over an extent of Ac.54.00 cts in Sy.No.721/4, Medipentla village, Vemula Mandal, YSR Diwstrict, on 8.10.2015, and on receipt of the application, the Assistant Director of Mines and Geology forwarded the same to the District Collector and requested for submission of classification and availability of the land over the subject area applied for. On coming to know about the amended rules, the petitioner deposited the amount towards application fee and other charges and submitted the same on 8.5.2017. The Assistant Director of Mines and Geology has kept the application pending and has not processed the same. Aggrieved by the same, the petitioner filed this writ petition. 3.
Heard and perused the material available on record. 4.
When this matter has come up for hearing, it is brought to the notice of this Court by the learned Government Pleader for Mines and Geology that the application of the petitioner has already been rejected on 16.11.2016. A copy of the said proceedings has also been placed before this Court.

Considering the above submissions, this Court is of the view that this writ petition has become infructuous. However, it is left open to the petitioner to challenge the rejection proceedings by way of filing a fresh petition, if he so desires.
