THE HONOURABLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE NO.621 OF 2019

O R D E R

The fourth respondent is present in person. The presence of respondents 1 to 3 was already dispensed with by way of a separate order passed on 09.07.2019 in I.A.Nos.1, 2 and 3 of 2019 filed in this contempt case. This contempt case was instituted alleging willful disobedience to the order dated 15.02.2019 passed in W.P.No.3070 of 2019. By the said order, the Tahsildar, Rajapet, Yadadri Bhongir District, was directed to take appropriate action upon the petitioner's application in Form VI(A) filed under the Telangana Rights in Land and Pattadar Pas Books Act, 1971, for mutation. The counter-affidavit filed by the fourth respondent Tahsildar demonstrates that after giving notice to the petitioner which remained unserved, be it for whatever reason, she considered the request of the petitioner for mutation, in part, under proceedings dated 11.04.2019. A copy of the said proceedings is placed on record.

In the light of the aforestated development, there is no possibility of inferring any disobedience, much less willful disobedience, on the part of the fourth respondent Tahsildar, though there appears to be some amount of delay. The contempt case is accordingly closed leaving it open to the petitioner to seek redressal of her grievance, if any, with regard to the proceedings dated 11.04.2019 independently in accordance with law.
