THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36805 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the third respondent in not registering the crime against the unofficial respondents 4 to 9 in connection with the damaged property and trespassed into the petitioner lands situated in Survey No.936 to an extent of Acs.3.31 guntas of Rasoolgudem, H/o Aitipamula Village, Kattangur Mandal, Nalgonda District covered under Decree and Judgment passed in O.S.No.139 of 2014, dated 12.11.2015 in spite of the written complaint dated 22.10.2016 and 24.10.2016 as illegal and arbitrary, and consequently, to direct the third respondent to provide police protection to the petitioner lands by registering the crime against the respondents 4 to 9. Heard and perused the material.

Learned counsel for the petitioner submits that though the petitioner lodged the complaints, dated 22.10.2016 and 24.10.2016, the third respondent is not registering the complaint and as such, he prays this Court to direct the third respondent to register the complaint and take action against the accused.

Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to the third respondent to register the complaint of the petitioner, if it discloses any cognizable offence and conduct effective investigation and file final report, if any, in accordance with law.
