THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.25675 OF 2006 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue a writ, order or direction more particularly one in the nature of writ of Mandamus, by declaring the Notification in Reference No.G3/2196/2006, dated 04.11.2006 issued by the 1st respondent is illegal and arbitrary, consequently to set aside the Notification in Reference No.G3/2196/2006 dt.04.11.2006 in the interest of justice and pass such other order or orders as this Honourable Court may deem fit and proper in the circumstances of the case."

When the matter is taken up for hearing, learned counsel for the petitioner as well as the learned Government Pleader for Land Acquisition appearing for the respondents stated that the petitioner approached this Court at the time of Enquiry under Section 5(A) of the Land Acquisition Act, 1894 and presently, the respondents are not intending to proceed with the land acquisition proceedings insofar as the land in question is concerned since some other land was acquired for providing house sites to the weaker sections under "Indiramma Padhakam".

Recording the aforesaid submission, this Writ Petition is closed. There shall be no order as to costs. 4.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
