THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY CIVIL REVISION PETITION No.1338 OF 2016 ORDER:

This revision petition is filed questioning the maintainability of E.P.No.17 of 2015 in O.S.No.139 of 2013 on the file of Additional District Judge, Adoni, by stating that respondent No.1 - decree holder has already filed two Execution Petitions being E.P.No.29 of 2015 before the I Additional District Judge, Kurnool, and E.P.No.14 of 2015 before the I Additional District Judge, Anantapur, and as such, the Court below has no jurisdiction to entertain the present E.P. and it ought not to have issued notice.

A perusal of the record discloses that no order is passed in the present E.P. Therefore, the petitioner can raise all his objections in E.P.No.17 of 2015 and the Court below shall take the same into account while passing any order in the said E.P., and if the petitioner is still aggrieved, it is open for him to challenge such order.

With the above observations, the revision petition is dismissed. Miscellaneous Petitions, if any, pending in this revision petition, shall stand closed. No costs. __________________________ A. RAJASHEKER REDDY, J
