Heard Sri Vedula Venkataramana, learned Senior Counsel for the appellants and Sri Ravindra Kumar, learned counsel for 2nd respondent.

2. This Second Appeal is filed challenging the decree dt.06-01-2016 in A.S.No.61 of 2015 of the Principal District and Sessions Judge, Warangal, confirming the judgment and decree dt.15-06-2015 in O.S.No.613 of 2011 on the file of the II Additional Junior Civil Judge, Warangal.

S.A.M.P.No.894 of 2016 has been filed by the parties to the Second Appeal under Order 23 Rule 3 CPC to record a compromise between them as mentioned in the Memorandum of Compromise dt.13-04-2016 annexed to the said application and to dispose of the appeal as well as the suit in terms of the said compromise.

The appellant Nos.2 and 3 as well as respondents are present in person.

1st appellant's representative is also present and they are identified by the counsel on record.

The respondents in the appeal stated categorically that they have signed the Memorandum of Compromise and they fully understood its purport. They have also stated that they have entered into this compromise with their free will and consent without any coercion by anybody.

6. After perusing the terms of the compromise, I am satisfied that the terms of compromise are lawful. 7.

Therefore, S.A.M.P.No.894 of 2016 is allowed and S.A.No.209 of 2016 as well as O.S.No.613 of 2011 are disposed of in terms of the conditions mentioned in the Memorandum of Compromise dt.13-04-2016 annexed to S.A.M.P.No.894 of 2016. No costs. 8.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
