THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.24288 of 2017 ORDER:

The petitioner prays for the following relief: "........Writ of Mandamus declaring the action of the respondents herein in not considering the claim of petitioner for admission into Ph.D (ECE) stream in spite of UGC JRF Fellowship grant as being illegal, arbitrary ......"

The counsel for petitioner by referring to Amendments to Ph.D Rules and Regulations-2013-2014 of Osmania University contends that petitioner is entitled for admission directly into Ph.D programme, for petitioner satisfies the requirements of Category-I (b) of the Rules referred to above.

Sri Adhi Venkateshwar Rao, the learned Standing counsel submits that this notification was issued in the year 2016 and there is no urgency in the writ petition and seeks time for filing counter affidavit.

The counsel for petitioner by referring to the very same grievance has made a few representations to respondent No.2 and further grievance is that these representations are not considered and disposed of till date. The admission into Ph.D course, if taken up, within the time schedule, it is for the benefit of individual as well as institution. The counsel for petitioner submits that the

representations may be directed to be considered and disposed of. Hence, the writ petition is disposed of, by the following order:

(a) The petitioner is given liberty to re-submit representations by enclosing a copy of this order within three (03) days from today.

(b) The 2nd respondent considers the representations along with application made by the petitioner in the light of applicable Rules, takes a decision and communicates to the petitioner within four (04) weeks.

(c) The petitioner subject to outcome of such communication can workout his remedies, if circumstances warrant.

No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
