O R D E R

With the consent of both the counsel, the matter is being disposed of at the stage of admission.

The case of the petitioner, as per the averments made in the affidavit filed in support of the writ petition, is that he is working as Deputy Executive Engineer in Public Health Sub-division, Ramagundam, Peddapalli District. On the ground that disciplinary proceedings vide G.O.Rt.No.736 Municipal Administration and Urban Development (Vig-II(1)) Department dated 20-11-2017, for the alleged incident pertaining to the year 2012/2013, are pending against the petitioner, respondents are not considering his case for promotion to the post of Executive Engineer. His grievance is that continuing the disciplinary proceedings without adhering to the time schedule under G.O.Ms.No.679 General Administration (Services-C) Department, dated 01-11-2008, and denying promotion, is illegal and arbitrary.

Learned counsel for the petitioner reiterating the above averments, further submits that Government issued G.O.Ms.No.257 dated 10.06.1999 framing guidelines to consider the cases of employees for promotion against whom disciplinary proceedings/criminal proceedings are pending, and that the case of the petitioner may be directed to be considered in terms of the said G.O. Learned Government Pleader for Services also submits that the case of the petitioner will be considered under the said G.O. Having regard to the facts and circumstances of the case and the submissions of the leaned counsel, without expressing any opinion on merits, writ petition is disposed of directing the respondents / competent authority, to consider the case of petitioner for promotion to the post of Executive Engineer in

terms of G.O.Ms.No.257 dated 10.06.1999, and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. Interlocutory applications, pending, if any, shall stand closed. No order as to costs.
