HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17668 of 2017 ORDER:

The present writ petition came to be filed seeking to declare the action of the 1st respondent in rejecting the representation dated 04.05.2017, vide order dated 12.5.2017, confirming the intimation notice dated 1.5.2017, for the land admeasuring Ac.17.54 cents situated at Sy.Nos.278/2A and 272/2B of Guravaigudem Village, Jangareddygudem Mandal, West Godavari District, without hearing the petitioner, as illegal and arbitrary. When the matter is taken up for hearing, the learned counsel for both parties submit that the high-tension wires are already laid in the subject lands and nothing survives for adjudication.

But, however, the learned counsel for the petitioner, submits that in the process of laying the high-tension wires, about 150 Coconut trees and 500 Cocoa trees were cut, as a result of which, financial loss has been caused to the petitioner. On the other hand, the learned Government Pleader for Revenue, would submit that the compensation for the loss/damage caused has already been paid to the petitioner. Be that as it may, if any loss or damage was caused to the petitioner, he is at liberty to initiate action against the respondents under Section 16(3) of the Indian Telegraph Act, 1985.

With the above observation, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
