THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36634 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of respondent No.2 in interfering with the rights of the petitioners at the instance of respondent Nos.3 to 8 yielding to the pressures brought out by them through their political identities by not permitting petitioner No.4 to conduct agricultural operations in an extent of Ac.24.00 guntas in Sy.No.400/A1 of Chimiryala Village and trying to settle the civil dispute even though he do not have any authority as being illegal and arbitrary and to pass any order as this Court feels fit and proper.

Heard and perused the material available on record. 3.

Learned Assistant Government Pleader for Home denied the entire allegations and submitted before this Court that respondent No.2 never interfered with the rights of the petitioners at the instance of respondent Nos.3 to 8 and he never tried to settle the civil disputes pending before the petitioners and respondent Nos.3 to 8.

Considering the rival contentions of both parties, this Court is of the view that the writ petition can be disposed of with the following direction:

Respondent No.2 is hereby directed not to interfere in any of the civil disputes pending before the petitioners and respondent Nos.3 to 8. At the same

time, the present order will not stand in the way of respondent No.2 to proceed with the investigation if any complaint is registered against the petitioners for a cognizable offence.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
