THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.8914 of 2013 ORDER:

In this Petition filed under Section 482 Cr.P.C., the petitioners/accused seek to quash the Proceedings in Cr. No.19 of 2013 on the file of Wardhannapet Police Station, Warangal Urban, whereunder the petitioners were charged for the offence under Section 3 (1) (x) of SCs and STs (POA) Act, 1989. When the matter came up for hearing, learned Public Prosecutor by producing a copy of Charge sheet submitted that the police have filed charge sheet and the same was taken cognizance and registered as S.C.No.13 of 2014 by the learned VII Additional District Judge-cum-Special Judge for trial offences under SCs and STs (POA) Act, 1989 and as such, the instant petition, which is filed for quashment of the FIR in Crime No.19 of 2013, became infructuous and thus liable to be dismissed.

Upon which, learned counsel for petitioners made an endorsement on the petition seeking permission of this Court to withdrawn the petition with a liberty to challenge the charge sheet by filing a petition afresh.

It is seen that pending Criminal Petition, no stay was granted. In view of the above respective submissions of both sides, this Criminal Petition, which is filed for quashment of the proceedings in Crime No.19 of 2013 on the file of Wardhannapet Police Station, is dismissed as infructuous and liberty is given to the petitioners to challenge the charge sheet filed by the police by filing appropriate petition.

Consequently, the miscellaneous petitions, if any, pending, in this case, shall stand closed.
